1. Acceptance of Terms

By accessing or using SilberhazeGenetics.com or Silberhaze.com (collectively, the “Site”), you agree to be bound by these Terms and Conditions (“Terms”), together with our Privacy Policy, Legal Disclaimers, and Newsletter Policy, which are incorporated by reference. If you do not agree, you must immediately discontinue use of the Site.

2. Scope and Nature of Silberhaze’s Activities

Silberhaze Genetics operates as a plant genetics research, development, and intellectual property organization. Our activities include, but are not limited to:

  • genetic research and cultivar development

  • intellectual property creation, stewardship, and licensing

  • educational and informational publishing

  • collaboration with properly licensed and authorized entities

Silberhaze does not operate as an unlicensed cannabis distributor, nursery, or retail seed seller.

Nothing on this Site shall be interpreted as:

  • an offer to sell cannabis or cannabis seeds to the general public,

  • an inducement to violate cannabis, controlled substances, or agricultural laws,

  • or a representation that any biological material is lawful in any specific jurisdiction.

  • All transfers of regulated plant material, if any, occur only where permitted by law and exclusively through licensed, authorized channels.

3. Jurisdictional Responsibility

You are solely responsible for determining whether access to this Site, or any interaction with Silberhaze, is lawful in your jurisdiction.

Laws governing cannabis, cannabis seeds, propagules, and genetic material vary by location and are subject to change. Silberhaze makes no representation that any content, reference, or material is lawful outside the jurisdiction in which Silberhaze operates or beyond licensed frameworks.

4. No Consumer Reliance / Educational Use Only

All content on the Site is provided for educational, informational, research, or intellectual property purposes only.

Nothing on the Site constitutes:

  • legal advice

  • regulatory advice

Users must not rely on Site content to make decisions regarding cultivation, possession, distribution, or compliance with law.

6. Biological Materials; No Guarantee; No Refunds

Where biological materials are referenced, described, or transferred through licensed channels:

  • Such materials are inherently variable and subject to environmental, biological, and regulatory factors beyond Silberhaze’s control.

  • No guarantees are made regarding germination, viability, phenotype expression, yield, or suitability.

  • All biological material is final sale. No refunds.

  • Any replacement consideration is discretionary and does not create precedent, obligation, or liability.

7. Intellectual Property & Genetic Rights

All genetic lines, cultivar names, breeding methodologies, trait descriptions, phenotypic data, imagery, text, and proprietary information are the exclusive intellectual property of Silberhaze Genetics or its licensors.

Unauthorized reproduction, propagation, breeding, reverse-engineering, selfing, backcrossing, or commercialization of Silberhaze genetics or derivative works is strictly prohibited.

Nothing in these Terms grants any rights to propagate or commercialize genetic material unless expressly authorized in a written licensing agreement.

8. Trademarks

All Silberhaze trademarks, service marks, logos, and trade dress are protected. Unauthorized use is prohibited.

9. User Conduct

Users agree not to engage in conduct that is unlawful, misleading, disruptive, infringing, or harmful, including but not limited to misuse of the Site or misrepresentation of Silberhaze’s activities.

10. User-Generated Content

By submitting content, users grant Silberhaze a perpetual, royalty-free, irrevocable license to use such content for operational, educational, or promotional purposes. Users represent they own or control all rights to submitted content.

11. Third-Party Content and Links

Third-party links are provided for convenience only. Silberhaze does not control or endorse third-party content and assumes no responsibility for it.

12. Limited License to Use the Site
